AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Adventure EV (“we,” “us,” or “our”), concerning your access to and use of the Adventure EV website, including any related pages, forms, inventory listings, media, mobile website, applications, tools, features, or services linked to or otherwise connected to the website (collectively, the “Site”).

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with all of these Terms of Use, you are expressly prohibited from using the Site and must discontinue use immediately.

Supplemental terms, policies, notices, or documents that may be posted on the Site from time to time are expressly incorporated into these Terms of Use by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date above. Your continued use of the Site after revised Terms of Use are posted means you accept the revised Terms of Use.

The Site is intended for users located in the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws, if and to the extent local laws apply.

The Site is intended for users who are at least 18 years old or the age of majority in their jurisdiction when submitting inquiries, requesting financing information, making purchase-related requests, or otherwise engaging in transaction-related activity. We do not knowingly collect personal information from children under 13.

VEHICLE LISTINGS, INVENTORY, PRICING, AND AVAILABILITY

The Site may display inventory listings, vehicle descriptions, photos, videos, specifications, features, colors, options, model information, condition information, mileage, hours, stock numbers, serial numbers, pricing, sale pricing, incentives, rebates, monthly payment estimates, financing examples, availability, and related information.

All such information is provided for general informational purposes only and may contain typographical errors, inaccuracies, omissions, outdated information, or other errors. Inventory is subject to prior sale, removal, transfer, or change without notice. We do not guarantee that any vehicle, product, accessory, part, price, incentive, promotion, or other offer displayed on the Site will be available, accurate, or current at the time you contact us or visit our location.

Unless expressly stated otherwise, prices shown on the Site may not include taxes, title, registration, documentation fees, delivery fees, destination charges, dealer-installed accessories, optional equipment, finance charges, insurance, warranties, or other fees and charges. Final pricing, availability, equipment, specifications, and terms must be confirmed directly with us before any purchase, lease, financing, or other transaction is completed.

Images, colors, features, and descriptions are for reference only and may not reflect the exact vehicle, product, or configuration available. We reserve the right to correct any errors, update any listing, change prices, remove inventory, or modify information on the Site at any time without prior notice.

FINANCING, PAYMENT ESTIMATES, AND CREDIT APPROVAL

The Site may display financing information, payment calculators, “as low as” monthly payment examples, interest rates, lender programs, down payment assumptions, promotional financing, or other finance-related information. Any such information is provided for general informational and estimate purposes only.

Actual financing terms, monthly payments, annual percentage rates, down payments, loan terms, taxes, fees, lender requirements, and approval decisions may vary based on credit approval, vehicle eligibility, lender rules, applicant qualifications, trade-in value, selected products or services, and other factors. Submitting a form, request, or application through the Site does not guarantee approval, availability, specific terms, or financing.

We may work with third-party lenders, financing companies, application providers, or other service providers. We are not responsible for the decisions, rates, terms, fees, privacy practices, acts, or omissions of any third-party lender or financing provider. You should carefully review all financing documents and lender disclosures before entering into any agreement.

ONLINE FORMS, LEADS, CALLS, TEXTS, AND COMMUNICATIONS

The Site may allow you to submit contact forms, sales inquiries, service requests, rental inquiries, trade-in information, financing inquiries, appointment requests, quote requests, or other communications. By submitting information through the Site, you represent that the information you provide is accurate, complete, and submitted by you or with proper authorization.

By submitting a form, calling us, emailing us, clicking a phone number, requesting information, or otherwise contacting us through the Site, you authorize us and our service providers to contact you regarding your inquiry by phone, email, text message, or other communication methods using the contact information you provide. Message and data rates may apply. Consent to receive marketing text messages is not required as a condition of purchase unless expressly stated in a separate consent disclosure.

We may use third-party tools, platforms, CRM systems, lead management systems, call tracking providers, form providers, email providers, advertising platforms, analytics tools, or other service providers to receive, process, route, store, analyze, or respond to inquiries.

USER REPRESENTATIONS

DISPUTE RESOLUTION

Informal Resolution

The parties agree to make a good faith effort to resolve any dispute for at least thirty (30) days before initiating litigation, except where immediate injunctive or equitable relief is necessary.

Venue and Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms of Use, the Site, or your use of the Site shall be brought exclusively in the state or federal courts located in Sumter County, Florida, and the parties consent to the personal jurisdiction and venue of those courts.

Class Action Waiver

To the fullest extent permitted by law, you and we agree that any dispute, claim, or controversy shall be brought only in an individual capacity and not as a plaintiff, claimant, or class member in any purported class, collective, consolidated, private attorney general, or representative proceeding.

Time Limitation

To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these Terms of Use, the Site, or your use of the Site must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred.

Equitable Relief and Exceptions

Nothing in this section prevents either party from seeking injunctive or equitable relief for claims involving intellectual property rights, unauthorized access, theft, privacy violations, security violations, fraud, misuse of the Site, or violation of applicable law.

TERMINATION

We may block IP addresses, restrict access, remove submissions, or take other measures we deem appropriate to protect the Site, our business, our users, and our rights.

MISCELLANEOUS

These Terms of Use and any policies or operating rules posted by us on the Site constitute the entire agreement and understanding between you and us regarding the Site. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision.

These Terms of Use operate to the fullest extent permitted by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.

If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable and does not affect the validity and enforceability of the remaining provisions.

There is no joint venture, partnership, employment, franchise, or agency relationship created between you and us as a result of these Terms of Use or your use of the Site. You agree that these Terms of Use will not be construed against us by virtue of having drafted them.
